Agreement to Terms

By accessing and using FormBuilder, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, you should not use this service.

Description of Service

FormBuilder is a web-based form creation and management platform that allows users to:

  • Create and customize online forms
  • Collect and manage form responses
  • Analyze form performance and data
  • Integrate with third-party applications
  • Sync responses to user-connected services such as Google Sheets

User Accounts

Account Creation

To use certain features of our service, you must create an account and provide accurate, complete information.

Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

Acceptable Use

You agree not to use FormBuilder to:

  • Violate any laws or regulations, including HIPAA
  • Collect sensitive information without proper consent
  • Collect PHI without executing a BAA when required
  • Send spam or unsolicited communications
  • Upload malicious content or malware
  • Impersonate others or provide false information
  • Interfere with the proper operation of our service
  • Attempt to circumvent security measures or access controls
  • Use the service for any unlawful or fraudulent purpose

Subscription and Billing

Paid Services

Some features require a paid subscription. By subscribing, you agree to pay all charges associated with your chosen plan.

Billing

  • Subscriptions are billed in advance on a monthly or annual basis
  • All payments are non-refundable except as required by law
  • We may change pricing with 30 days notice
  • Accounts may be suspended for non-payment

Data and Content

Your Content

You retain ownership of all content you submit to FormBuilder. You grant us a license to use, store, and process your content to provide our services.

Data Processing

We process your data in accordance with our Privacy Policy and applicable data protection laws, including GDPR and HIPAA where applicable.

Third-Party Integrations

You may choose to connect FormBuilder to third-party services, including Google Sheets. By connecting an integration, you authorize FormBuilder to send, receive, store, and process the information needed to operate that integration on your behalf.

  • You are responsible for choosing integrations and destination accounts you control or are authorized to use.
  • You can disable or disconnect integrations from your FormBuilder settings.
  • Third-party services may have their own terms, privacy policies, quotas, and security controls.
  • FormBuilder is not responsible for how third-party services process data after you direct FormBuilder to send data to them.

HIPAA Compliance and Healthcare Data

Business Associate Agreement

If you are a covered entity or business associate under HIPAA and use FormBuilder to collect, store, or process Protected Health Information (PHI), you must execute a Business Associate Agreement (BAA) with us. Contact [email protected] to request a BAA.

Your Responsibilities for PHI

When collecting PHI through FormBuilder, you are responsible for:

  • Obtaining appropriate consent from individuals
  • Limiting PHI collection to the minimum necessary
  • Training your employees on HIPAA requirements
  • Implementing appropriate access controls
  • Reporting any suspected breaches immediately
  • Maintaining your own HIPAA compliance program

Our HIPAA Safeguards

For accounts with an executed BAA, we implement:

  • AES-256-CBC encryption for PHI at rest
  • TLS 1.3 encryption for PHI in transit
  • Comprehensive audit logging of all PHI access
  • Data integrity verification
  • Automatic retention and deletion policies
  • Employee HIPAA training and access restrictions
  • Incident response and breach notification procedures

Breach Notification

In the event of a breach involving PHI, we will notify affected customers within 60 days as required by HIPAA. You agree to cooperate with us in investigating and remediating any breaches.

Service Availability

We strive to maintain service availability but do not guarantee uninterrupted access. We may:

  • Perform scheduled maintenance
  • Make updates and improvements
  • Experience unexpected downtime

Limitation of Liability

To the maximum extent permitted by law, FormBuilder shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use.

HIPAA Exception: For covered entities with an executed BAA, liability limitations shall be as specified in the BAA to comply with HIPAA requirements.

Indemnification

You agree to indemnify and hold harmless FormBuilder from any claims, damages, or expenses arising from your use of our service or violation of these terms.

Termination

Either party may terminate this agreement at any time. Upon termination:

  • Your access to the service will be suspended
  • You may download your data for 30 days
  • PHI will be retained or returned per HIPAA requirements and any BAA
  • Non-PHI data may be deleted after 90 days
  • Audit logs will be retained as required by law

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through our service.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of California, United States.
